1. Agreement
These Terms of Service (“Terms”) are an agreement between Nurdd Solutions Private Limited (CIN U73100HR2026PTC143293), Unitech Cyber Park, Sector 39, Gurugram, Haryana, India (“Nurdd”, “we”, “us”) and the person or organisation that signs up for or uses Noma (“you”).
By creating an account, starting a trial or using Noma, you agree to these Terms and to our Privacy Policy. If you use Noma for an organisation, you confirm that you are allowed to accept these Terms on its behalf.
2. Definitions
- “Service” means the Noma application, its features, and our website at nomahq.app.
- “Customer Data” means the data you put into Noma, such as brands, competitors, prompts and server logs, and the data Noma collects for you, such as AI engine answers and audit results.
- “Plan” means the subscription you choose, with its features, limits and fees.
3. The Service
Noma tracks and analyses how brands appear in AI answer engines, including visibility, position, sentiment and citations, and offers site audits, AI crawler and referral analytics, content drafts, recommendations, connections to Google services, and API access. Noma currently tracks ChatGPT (GPT-4o mini and GPT-5), Claude, Gemini, Perplexity, Grok, DeepSeek, Qwen and Mistral.
We may add, change or remove features and AI engines; engine providers can change or withdraw their models without notice to us. We will not materially reduce the core features of a paid Plan during a period you have already paid for without telling you first.
4. Eligibility and accounts
You must be at least 18 and able to enter into a binding contract. Keep your account details accurate and your sign-in credentials secure. You are responsible for activity under your account and for making sure the people you invite follow these Terms. Tell us straight away at support@nurdd.club if you think your account has been misused.
5. Trials, fees, billing and refunds
- Free trial: the trial lasts 3 days and includes 25 tracked prompts. It is free. We take a payment method at the start so that your chosen Plan can begin when the trial ends. If you cancel before the trial ends, you are not charged. If the trial ends without a paid Plan, your account becomes read-only and nothing is deleted. Trials are provided as they are, with no warranty.
- Plans and fees: self-serve Plans are Starter, Growth, Scale, Studio and Agency. Fees are the ones shown for your Plan when you buy it, are quoted and charged in US dollars, and do not include taxes, which you are responsible for. A subscription that was already set up in Indian rupees continues to be charged in rupees. Enterprise pricing is agreed separately.
- Taxes and invoices: customers billed in India pay GST at the applicable rate on top of the fee. Supplies to customers outside India are treated as exports where the law allows. We issue a tax invoice for each payment, using the billing details you give us, so keep them accurate.
- Billing and renewal: payments are taken through our payment processors as a recurring mandate you authorise at checkout. Subscriptions are billed in advance for each billing period and renew automatically until you cancel. The annual rate is billed monthly and can also be cancelled at any time.
- Price changes: we may change our prices. A change applies to you from your next billing period after we have told you about it.
- Cancellation: you can cancel at any time. Cancellation takes effect at the end of the current billing period, and you keep access until then.
- Refunds: fees are non-refundable, except where the law requires a refund.
6. Acceptable use
You must not, and must not help anyone else to:
- copy, reverse engineer or try to extract the source code of the Service;
- resell, sublicense or provide the Service to others, except for client work on agency Plans as those Plans allow;
- use the Service to build or benchmark a competing product;
- scrape the Service, or get around its usage limits, security or access controls;
- overload or disrupt the Service or the providers it relies on;
- track prompts, or generate content, that break the law or the usage policies of the AI engines Noma queries, or that contain other people’s sensitive personal data;
- connect a Google account, Ads account or website, or send us server logs, that you are not authorised to use for this purpose;
- put unlawful or infringing content into the Service, or use it in breach of any law or anyone else’s rights.
7. Your data
You own your Customer Data. You give us permission to host, process and use it only to provide and improve the Service, as described in our Privacy Policy. We do not sell Customer Data, and we do not use it to train AI models.
If you use Noma for clients, for example on an agency Plan, you are responsible for having each client’s permission to put their data into Noma and to connect their accounts.
If you need a data processing agreement for personal data in your Customer Data, contact legal@nurdd.club. We will also give you the current list of the providers who process it on our behalf.
8. Server logs you send us
If you send us server logs for Agent Analytics, you confirm that you have the right to share them with us for that purpose, and that you have told your website’s visitors what you need to, for example in your own privacy notice. We process personal data in those logs on your behalf and only to provide the Service.
9. API keys and integrations
If you create API keys, for example to send server logs or to connect an AI assistant to Noma, keep them secret and send them in request headers rather than in links. Anything done with your keys counts as done by you. You can revoke a key at any time, and we may revoke or rate-limit keys that put the Service at risk.
10. Referral programme
- Customers can share a referral link. A new workspace that signs up through it gets 30% off its Plan for its first 6 months.
- The referrer earns 20% of what that workspace pays for its first 6 months as a paying customer. Commission is held for 30 days against refunds and cancellations, and is paid once it reaches the minimum payout of US$20 (or ₹2,000 for referrers paid in rupees).
- Referring yourself, your own organisation or a workspace that is already a customer does not count, and nor do referrals gained through spam, paid ads on our brand name, or misleading claims. We may withhold commission earned that way.
- We may change or end the programme for future referrals by updating this section. Commission already earned under the old terms is still paid.
11. Intellectual property and feedback
We and our licensors own the Service, its software and its content, other than your Customer Data. While your subscription is active, we give you a limited, non-exclusive, non-transferable right to use the Service under these Terms. If you send us ideas or feedback, we may use them freely, without any obligation to you.
12. AI engines, outputs and third-party services
Noma works by querying third-party AI engines through their APIs, and public sources. Their answers are generated by those engines, can be inaccurate or incomplete, and change over time. Answers from an API can also differ from what a person sees in the engine’s own app, which may use other models, settings, location or account history. We do not control those engines and are not responsible for what they say. Noma’s metrics and recommendations are estimates for information only, and are not legal, financial or other professional advice. Check anything important before relying on it.
Content Noma generates for you: drafts, images and suggestions are produced by AI models. As between you and us, you own what Noma generates for you, to the extent the law allows anyone to own it. Similar output may be generated for other customers. Review it before you publish or use it; you are responsible for what you publish.
Services you connect to Noma, such as Google Search Console, Google Analytics and Google Ads, are subject to their own terms. Noma uses them read-only: it never creates, edits or deletes your Google data, campaigns, ads, budgets or settings. Our use of information received from Google APIs follows the Google API Services User Data Policy, including its Limited Use requirements.
13. Confidentiality
Each of us will protect the other’s non-public information that we receive in connection with the Service, and use it only to perform under these Terms, unless the law requires us to disclose it.
14. Availability
We work to keep the Service available, but self-serve Plans do not come with a service level commitment. Any service level agreement is set out in a separate written agreement, such as an Enterprise contract.
15. Disclaimer
The Service is provided “as is” and “as available”. To the fullest extent the law allows, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or the accuracy or availability of data derived from AI engines.
16. Limitation of liability
To the fullest extent the law allows, neither of us is liable to the other for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue or data.
Our total liability for all claims arising out of or relating to the Service is limited to the fees you paid us in the 12 months before the event that gave rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
17. Indemnity
You will defend and compensate us against claims by third parties that arise from your Customer Data, from your use of the Service in breach of these Terms, or from your breach of any law or of anyone else’s rights.
18. Suspension and termination
These Terms apply for as long as you use the Service. We may suspend or end your access if you breach these Terms, do not pay, or put the Service or others at risk. Where it is reasonable, we will tell you first and give you a chance to fix the problem. When your access ends, your right to use the Service ends too. Before then you can export your data with the export tools in the application, or ask support@nurdd.club for a copy in a common machine-readable format. After termination we may delete Customer Data, and we will delete it when you ask, subject to what the law requires us to keep.
19. Publicity
We will not use your name or logo to promote Noma without your permission.
20. Governing law and disputes
These Terms are governed by the laws of India. If a dispute arises, please write to legal@nurdd.club first so we can try to resolve it informally. If it cannot be resolved, the courts at Gurugram, Haryana, India have exclusive jurisdiction.
21. Changes to these Terms
We may update these Terms. We will post the new version here with a new “Last updated” date, and for significant changes we will tell you by email or in the application before they take effect. If you keep using the Service after a change takes effect, you accept the updated Terms.
22. General
These Terms, together with the Privacy Policy and any order or agreement for your Plan, are the whole agreement between us about the Service. If any part is found unenforceable, the rest still applies. We may transfer these Terms to an affiliate or as part of a merger, acquisition or sale of assets; you may not transfer them without our written consent. Neither of us is responsible for delays caused by events beyond reasonable control. You must comply with applicable export control and sanctions laws.
